By accessing or using our website at simracing.fan and any related services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Platform.
1. Definitions
- “Platform”: the website simracing.fan, including all its sections, features, and services (community, marketplace, classifieds, resources, events, discussions).
- “User”: any individual who accesses, browses, registers on, or uses the Platform.
- “Account”: a registered user profile on the Platform.
- “Content”: any text, image, video, listing, resource, event, discussion, review, comment, or other material posted on the Platform.
- “User Content” or “UGC”: Content created and published by Users.
- “Vendor”: a User who operates a store on the Platform’s marketplace to sell products or services.
- “Buyer”: a User who purchases products or services through the Platform’s marketplace.
- “Marketplace”: the multi-vendor e-commerce section of the Platform powered by WooCommerce and WCFM Marketplace.
- “Classifieds”: the peer-to-peer listing section where Users can post buy/sell/trade ads.
- “Digital Products”: downloadable or virtually delivered products such as sim racing setups, skins, liveries, or similar files.
2. Eligibility and Account Registration
2.1 Age Requirement
You must be at least 16 years old to create an Account on the Platform. If you are between 16 and 18, you represent that you have your parent’s or legal guardian’s consent to use the Platform. Users under 16 may not create an Account.
2.2 Account Creation
You may register using email and password, or through third-party authentication providers (currently: Discord, Steam, Twitch, Google). When using third-party login:
- We receive only the information authorized by the provider and by you during the authentication flow.
- We do not receive or store your password for any third-party service.
- You remain bound by the terms of service of the respective third-party provider.
2.3 Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account. You must notify us immediately at info@simracing.fan if you suspect unauthorized access to your Account.
2.4 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update it as necessary. Accounts with deliberately false information may be suspended or terminated.
2.5 One Account Per Person
Each individual may maintain only one Account. If duplicate accounts are discovered, we reserve the right to merge or deactivate them.
3. Acceptable Use and Code of Conduct
3.1 General Conduct
Users agree to use the Platform lawfully, respectfully, and in compliance with these Terms and all applicable laws. The Platform is a community built “by racers, for racers” — we expect all interactions to reflect that spirit.
3.2 Prohibited Conduct
You may not:
- Post content that is defamatory, threatening, harassing, discriminatory, obscene, or otherwise objectionable.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Post spam, chain letters, pyramid schemes, or unsolicited commercial messages.
- Attempt to gain unauthorized access to other Users’ accounts, the Platform’s systems, or connected third-party services.
- Use bots, scrapers, or automated tools to access the Platform without prior written permission.
- Manipulate ratings, reviews, or engagement metrics.
- Post content that infringes on intellectual property rights of third parties.
- Use the Platform to facilitate illegal transactions or activities.
- Circumvent any moderation, security, or access control measures.
3.3 Content Moderation
We reserve the right to review, edit, or remove any User Content that violates these Terms, without prior notice. Content moderation decisions are at our sole discretion. Certain content categories (such as resources related to coaching, hardware, and software) are subject to review before publication.
3.4 Account Suspension and Termination
We may suspend or terminate your Account, with or without notice, if you violate these Terms, engage in prohibited conduct, or if we reasonably believe your Account poses a risk to the Platform or other Users.
4. User-Generated Content
4.1 Ownership
You retain ownership of the Content you create and post on the Platform (discussions, resources, events, classifieds, reviews, comments, profile information).
4.2 License Grant
By posting Content on the Platform, you grant Simracing.Fan a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, distribute, and create derivative works from your Content, solely for the purposes of operating, promoting, and improving the Platform. This license continues even if you delete the Content (to the extent copies have been shared, cached, or archived), but we will make reasonable efforts to remove deleted Content from active display.
4.3 Content Responsibility
You are solely responsible for the Content you publish. You represent and warrant that:
- You have all necessary rights, licenses, and permissions to post such Content.
- Your Content does not infringe on any third party’s intellectual property, privacy, or other rights.
- Your Content is accurate and not misleading.
4.4 No Obligation to Monitor
We are not obligated to monitor all User Content, but we reserve the right to do so. We may use automated systems or community reporting mechanisms to identify potentially objectionable Content.
5. Marketplace — Multi-Vendor
5.1 Platform Role
Simracing.Fan operates as a marketplace platform connecting Vendors and Buyers. We are not a party to transactions between Vendors and Buyers. We do not manufacture, store, ship, or inspect any physical products listed on the Marketplace. For digital products, we provide the delivery infrastructure but do not create the content.
5.2 Vendor Responsibilities
Vendors are independently responsible for:
- The accuracy and completeness of product listings (descriptions, images, specifications, pricing).
- Compliance with all applicable laws regarding the products or services they sell (consumer protection, product safety, tax obligations).
- Fulfillment of orders: packaging, shipping, delivery, and customer service.
- Handling returns, refunds, and exchanges in accordance with applicable law and their posted store policies.
- Maintaining appropriate business licenses and tax registrations as required by their jurisdiction.
- Ensuring that product images and descriptions do not infringe on third-party intellectual property rights.
5.3 Buyer Responsibilities
Buyers are responsible for:
- Reading product descriptions, specifications, and store policies before purchasing.
- Providing accurate shipping information.
- Communicating directly with the Vendor regarding order inquiries, issues, or returns.
5.4 Transactions
- All prices are displayed in the currency indicated on the product page.
- Payment processing is handled through the Platform’s integrated payment gateway(s). The Platform may collect a commission on sales, as specified in the Vendor agreement.
- Once an order is placed and payment is confirmed, the Vendor is responsible for fulfillment.
5.5 Disputes Between Buyers and Vendors
- We encourage Buyers and Vendors to resolve disputes directly.
- If a resolution cannot be reached, either party may contact us at info@simracing.fan. We may, at our sole discretion, mediate the dispute, but we are not obligated to do so.
- We reserve the right to issue refunds, hold payments, or take other action if we determine that a Vendor has acted in bad faith or violated these Terms.
5.6 Digital Products
- Digital products (sim racing setups, skins, liveries, data files, etc.) are delivered electronically.
- Due to the nature of digital products, refunds are generally not available once the product has been downloaded or accessed, unless the product is defective, not as described, or applicable law requires otherwise.
- Vendors of digital products must clearly indicate in their listings that the product is digital and non-refundable after download.
5.7 No Endorsement
Listing a product or Vendor on the Platform does not constitute an endorsement, recommendation, or guarantee by Simracing.Fan regarding the quality, safety, legality, or any other aspect of the product or Vendor.
6. Classifieds (Peer-to-Peer Listings)
6.1 Nature of Classifieds
The Classifieds section allows Users to post buy, sell, trade, or community-related ads. Classifieds are peer-to-peer: transactions occur directly between Users, outside of the Platform’s payment infrastructure.
6.2 User Responsibility
Users posting classifieds are solely responsible for the accuracy of their listings and for completing any transactions. Simracing.Fan does not verify listings, inspect goods, or facilitate payments for classifieds.
6.3 Prohibited Listings
The following are prohibited in classifieds: counterfeit or stolen goods, items that violate applicable law, misleading listings, and any content that violates Section 3 of these Terms.
7. Resources and Events
7.1 User-Submitted Resources
Users may submit resources (track guides, coaching profiles, community pages, hardware resources, software tools, etc.). Resources are User Content subject to Section 4 of these Terms and to content moderation as described in Section 3.3.
7.2 User-Submitted Events
Users may create and publish events (races, championships, community gatherings). Event organizers are solely responsible for the accuracy of event information (dates, rules, registration details) and for the organization and execution of their events.
7.3 Coaching and Services
Resources that advertise coaching, instruction, or other services represent a direct relationship between the service provider and the client. Simracing.Fan is not a party to any service agreement. Users engaging coaching or similar services should exercise due diligence and agree on terms directly with the provider.
8. Intellectual Property
8.1 Platform IP
The Simracing.Fan name, logo, visual design, original content, graphics, software, and other materials created by us are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute our intellectual property without our prior written consent.
8.2 User Content IP
User Content remains the intellectual property of the respective User, subject to the license granted in Section 4.2.
8.3 Copyright Complaints
If you believe that Content on the Platform infringes your copyright, please contact us at info@simracing.fan with: (a) a description of the copyrighted work, (b) the URL of the infringing material, (c) your contact information, and (d) a statement that you have a good faith belief that the use is not authorized. We will investigate and take appropriate action, which may include removing the Content.
9. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of personal data is described in our separate Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the practices described in the Privacy Policy.
10. Donations and #SimracingForGood
10.1 Charitable Component
Simracing.Fan partners with World Vision for the #SimracingForGood initiative. Donations made through the Platform are processed through World Vision’s systems and are subject to World Vision’s terms and policies.
10.2 Simracing.Fan’s Role
Simracing.Fan facilitates awareness and engagement with the #SimracingForGood initiative but does not directly handle charitable funds. Tax deductibility of donations depends on your jurisdiction and should be verified independently.
11. Third-Party Services and Links
11.1 Third-Party Authentication
The Platform integrates with third-party authentication providers (Discord, Steam, Twitch, Google). Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.
11.2 External Links
The Platform may contain links to third-party websites or services. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites.
11.3 Embedded Content
User Content may include embedded media from third-party platforms (YouTube, Twitch, Kick). Such content is subject to the terms of the respective platform.
12. Limitation of Liability
12.1 Platform Provided “As Is”
The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.2 No Guarantee of Availability
We do not guarantee that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
12.3 Limitation
To the maximum extent permitted by applicable law, Simracing.Fan, its operators, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Platform or any transaction conducted through it.
12.4 Cap on Liability
Our total aggregate liability for any claims arising out of or related to these Terms or your use of the Platform shall not exceed the greater of: (a) the amount you have paid to Simracing.Fan in the twelve (12) months preceding the claim, or (b) €100.
13. Indemnification
You agree to indemnify, defend, and hold harmless Simracing.Fan, its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform, (b) your violation of these Terms, (c) your Content, or (d) your violation of any rights of any third party.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Italian Republic, without regard to conflict of law principles.
14.2 Jurisdiction
Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of [CITY — to be determined after SRLS incorporation], Italy.
14.3 EU Consumer Rights
If you are a consumer residing in the European Union, nothing in these Terms affects your mandatory consumer rights under the laws of your country of residence, including your right to bring proceedings in the courts of your country.

In accordance with EU Regulation 524/2013, consumers in the EU may use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify registered Users (e.g., via email or Platform notification).
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with the Privacy Policy and any applicable Vendor agreements, constitute the entire agreement between you and Simracing.Fan regarding your use of the Platform.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
16.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
16.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
